Welcome to RoyalNest. This agreement constitutes a legally binding contract between the Platform and its users (Agencies and Customers). By browsing the website, creating an account, or utilizing any of our services, you acknowledge your full and unconditional acceptance of, and compliance with, these terms. These terms are governed by the digital and commercial legislations in force in the People's Democratic Republic of Algeria, particularly Law No. 18-05 concerning Electronic Commerce, and Law No. 18-07 concerning the Protection of Personal Data.
02. Definitions
The Platform / Administration
Refers to the RoyalNest application, website, its legal representatives, and system administrators (Admins).
Real Estate Agency (Agent)
Any natural or legal person (office, company, certified agent) registering on the platform to display properties for sale or rent.
User (Customer)
Any individual browsing the platform, viewing listings, interacting with them (likes), or contacting agencies.
Listing / Post
All data, media, pricing, and descriptions related to real properties uploaded by the Agencies.
03. User Obligations & Sanctions (Regular Users)
Serious and Responsible Use: Regular users are obligated to use the platform solely for legitimate real estate inquiries and to maintain professional and respectful communication with agencies.
Suspension and Deletion Policy
Although user accounts are free, the RoyalNest administration retains the absolute right to suspend or permanently delete a regular user's account without prior notice, based on agency reports or automated detection systems, in the following cases:
If the user is proven to be reckless, notoriously unserious, or harassing agencies without any genuine intent to transact.
If the account is found to be operating as a "Bot" or an automated fake account spamming the platform.
If the user uses profane, obscene, or abusive language in chats, messages, or interactions.
04. Membership, Audit, & Manual Verification System
The platform implements a strict verification protocol to maintain a secure digital real estate environment:
Initial Registration & Posting: Upon registration, Agencies can benefit from a free trial period allowing them to publish a limited number of listings (3 to 5 posts) for a duration of 14 days.
"Unverified" Badge: All listings published by newly registered agencies will automatically display an "Unverified" badge. This serves as an explicit legal disclaimer warning users to proceed with caution. The Platform disclaims all liability for transactions conducted under this status.
Manual Verification (CNRC): The Platform administration manually verifies the legitimacy of the agency by cross-referencing the submitted Commercial Registry number with the official platform of the National Center of the Commercial Register (CNRC) and reviewing submitted official documents.
"Verified" Badge: Once the administration confirms the validity of the documents, the account status changes to "Verified", and subsequent listings will display this badge, indicating that the platform has exercised due diligence in verifying the publisher's identity.
Tiered Subscription System: The platform’s business model relies on paid monthly subscriptions. The cost and benefits vary depending on the package chosen, which dictates the maximum number of listings an Agency can publish during that month.
Non-Refundable Policy: All payments made to the platform for activating subscription packages are final and strictly non-refundable under any circumstances.
Visibility Reduction (Shadow Banning): Upon receiving repeated verified reports against a specific agency (e.g., incorrect pricing, fake photos, or misleading data), the system automatically reduces the visibility and reach of its listings in search results and feeds.
Temporary Ban & Subscription Freezing: Upon detecting serious violations, the Admin will ban the agency's account, hide its listings from the platform, and temporarily freeze the active subscription.
Resumption After Amicable Settlement: If the agency contacts the administration via the internal messaging system, resolves the issue amicably, proves good faith, and corrects the violation, the agency is entitled to resume and reactivate its subscription normally to utilize the remaining period without losing it.
The Legal Time-Limit (Subscription Forfeiture): The option to resume a frozen subscription is not indefinite. If the agency remains banned and the dispute is not amicably resolved for a prolonged period reaching two months (60 days), the paid subscription will be completely and permanently forfeited. The agency will have no right to claim the remaining period or any financial compensation, and the account may be permanently deleted.
06. Privacy Policy & Protection of Personal Data (Law 18-07)
In compliance with Algerian data protection laws, we ensure absolute transparency regarding data collection and visibility permissions:
A. Data Collection and Visibility Permissions
Publicly Visible Information: To facilitate seamless communication and foster digital trust, only the following details are visible to the public:
For Regular Users: First name, last name, email address, and phone number.
For Real Estate Agencies: Agency name, public email address, and public phone number, allowing clients to recognize and contact them.
Confidential & Protected Information (Admin-Only): In strict compliance with privacy standards, all sensitive corporate and personal verification data are completely hidden from the public and can only be accessed by the Platform Administration (Admin) for manual auditing purposes. This includes:
National Identification Number (NIN).
Commercial Registry (CR) number and National ID Card number.
Uploaded supporting documents in (PDF/Image) formats, such as copies of the Commercial Registry and both sides of the National ID Card.
B. Chat and Communication Monitoring Policy
The platform strictly respects the privacy of correspondence. Administrators do not monitor or inspect daily private chats between agencies and users.
Legal Exception: The platform administration retains the absolute legal right to review and inspect bilateral chat logs only and exclusively in the event of an official complaint or fraud report, to verify claims, resolve internal disputes, and enforce necessary penalties.
07. Limitation of Liability
The role of RoyalNest is strictly limited to providing a digital intermediary space (Hosting / Hébergement) connecting real estate agencies with customers.
The platform is not a party to any sale, purchase, lease agreements, or financial transactions conducted outside the application. It bears no civil or criminal liability for fraud, misrepresentation, or breach of contract committed by any party.
08. Governing Law & Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of the People's Democratic Republic of Algeria. Any unresolved disputes arising between the user and the platform shall be subject to the exclusive jurisdiction of the competent courts located within the territorial jurisdiction of the platform's headquarters.
